These Terms of Service (“Terms”) govern your use of OmidFitPro’s online fitness coaching, nutrition planning samples, and custom workout services. By purchasing or using our services, you agree to these Terms.

Services and Payment: OmidFitPro provides digital fitness and nutrition coaching services only. Fees for our programs and plans are due upfront and are stated in Australian dollars (AUD), inclusive of any applicable GST. We accept payment by the methods specified on our website. Currently, all purchases are one-off; we do not offer subscriptions, automatic renewals or free trials. (We reserve the right to introduce subscription or trial options in the future, with your consent.) Payment processing is handled via secure third-party services; we do not store your payment card details.

Cancellations and Refunds: Because our services are delivered digitally, all purchases are final once the service has commenced or the product has been delivered. If you wish to cancel before a service or program has started, you may contact us to request a refund; such refunds are granted at our discretion, except where the law (Australian Consumer Law) requires otherwise. After a program has begun (e.g. after we have provided access to a meal plan or conducted coaching sessions), we generally cannot offer a refund. Nothing in these Terms limits your rights under the Australian Consumer Law (ACL); for example, if our services are not provided with due care and skill, you may be entitled to a remedy under the ACL. We will not mislead you about your ACL rights or attempt to contract out of them.

Delivery of Services: Upon receiving payment, we will make reasonable efforts to deliver the agreed services (such as sending digital meal plans or scheduling video coaching sessions). All content and communications are delivered via our online platform or email/video calls. We do not guarantee any specific fitness or health results, as outcomes depend on many factors outside our control.

Your Obligations: You represent that all information you provide to us is accurate and complete. You should consult a qualified healthcare professional before starting any new diet or exercise program, and it is your responsibility to disclose any medical conditions or physical limitations to us. You must follow any safety advice we provide (e.g. warm-up instructions). You participate in all activities and follow all program recommendations at your own risk.

Health Disclaimer: Our coaches are fitness professionals, not medical doctors. The advice and content we provide (including workout routines and nutrition guidelines) are for general information only. OmidFitPro’s programs are not a substitute for professional medical advice, diagnosis, or treatment. If you experience any pain or unusual symptoms while using our programs, stop immediately and consult a physician. As noted above, “clients participate at their own risk,” and it is strongly recommended that you get clearance from a doctor before beginning any strenuous fitness programs. We will not be liable for any injuries or health issues resulting from your use of our services.

Intellectual Property: All materials provided by OmidFitPro – including workout plans, meal plans, training videos, and written content – are owned by us and protected by intellectual property laws. You may view and use these materials for your personal, non-commercial use only. You must not copy, reproduce, distribute, or create derivative works based on our content without our prior written permission.

Privacy: We collect, use, and disclose your personal information as described in our Privacy Policy above. By using our services, you consent to this handling of your data.

Limitation of Liability: To the fullest extent permitted by law, OmidFitPro (and its owners and employees) disclaims all liability for loss or damage (whether direct, indirect, or consequential) arising from your use of our services, including any personal injury. We provide our services “as is” and make no warranties or guarantees except those required by law. Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law. In particular, we do not exclude liability for death or personal injury caused by our negligence. Your sole remedy for any problem with our services is for us to re-perform the services or issue a refund, in line with consumer law.

Indemnity: You agree to indemnify and hold OmidFitPro, its affiliates and employees harmless from any claims, losses, damages or liabilities (including legal costs) arising out of your breach of these Terms or your use of our services (including any injury you suffer).

Governing Law: These Terms are governed by the laws of the State of Victoria and the Commonwealth of Australia. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the courts of Victoria. You waive any right to claim that courts in other jurisdictions may apply a different law.

Changes to Services or Terms: We reserve the right to modify, suspend, or discontinue any part of our services at any time (for example, changing program features or introducing subscriptions). We may also update these Terms from time to time. We will post the updated Terms on our website and notify you of any significant changes (for example, via email or a notice on our platform). Your continued use of our services after changes are posted constitutes acceptance of the new Terms.
